FORECLOSURE NOTICE



DEFAULT having been made in the payment of the indebtedness described in and secured by that certain mortgage executed by BRIAN LEE O'LEARY and CHRISTINE O'LEARY, husband and wife, as Mortgagor(s) to Mortgage Electronic Registration Systems, Inc., acting solely as nominee for Equipoint Financial Network, Inc., as Mortgagee, dated the 10th day of May, 2007, and recorded in MTG Book 1522, Page 118 and modified by instruments recorded in MTG Book 1718, page 826 and MTG Book 1737, page 875, et seq. of the records in the Office of the Judge of Probate Court of Cullman County, Alabama; said mortgage being lastly assigned to BANK OF AMERICA, N.A. by instrument recorded in said Probate Court records; said default continuing, notice is hereby given that the undersigned will, under and by virtue of the power of sale contained in said mortgage sell at public outcry for cash to the highest bidder during legal hours of sale, on the 25th day of May, 2017, in the city of Cullman, at the front Door of the Court House of Cullman County, Alabama, the following described real property situated in the County of Cullman, State of Alabama, to-wit:



A tract of land lying in the Northeast Quarter of the Northwest Quarter of Section 16, Township 9 South, Range 4 West, Cullman County, Alabama, and being more particularly described as follows: Beginning at the Northeast corner of said Northeast Quarter of the Northwest Quarter and thence North 89 degrees 08 minutes 57 seconds West along the North line of said Northeast Quarter of Northwest Quarter 491.60 feet to a capped ½ inch iron pin, and the true point of beginning; thence South 0 degrees 51 minutes 03 seconds West 435.00 feet to a capped ½ inch iron pin; thence North 89 degrees 08 minutes 57 seconds West 402.00 feet to a capped ½ inch iron pin; thence continue North 89 degrees 08 minutes 57 seconds West 15.0 feet to the center of Bone Creek; thence Northerly along said center of creek, as it meanders 600 feet, more or less, and having a chord of North 5 degrees 03 minutes 29 seconds East 436.17 feet to the North line of said Northeast Quarter of Northwest Quarter; thence South 89 degrees 08 minutes 57 seconds East 385.00 feet to the true point of beginning. Capped ½ inch iron pins are marked "Gurney L.S. #11083". Subject to right of way for County Road No. 1233 along the North boundary.



This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, reservations and exceptions reflected in the mortgage and/or those contained in the records of the office of the Judge of Probate of the county where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto. Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances. Said sale will be made for the purpose of paying said indebtedness and the expenses incident to this sale, including a reasonable attorney's fee, and the other purposes set out in said mortgage. The sale will be conducted subject to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and also to final confirmation and audit of the status of the loan with the Mortgagee.
