WHEREAS, on the 12h day of October, 2005, Kenneth Richard Dees and Stacey Dees, did execute and deliver to Merchants Bank a mortgage on real estate hereinafter described, which mortgage appears of record in the Office of the Judge of Probate of Cullman County, Alabama, in Mortgage Book 1448, Page 38.

WHEREAS, default has been made in the payment of said mortgage in favor of MERCHANTS BANK provided therein, which default continues at this date, and said mortgage is subject to foreclosure.

NOW, THEREFORE, three weeks notice is hereby given that the undersigned will sell at public outcry to the highest bidder for cash, at the front door of the Cullman County Courthouse, Cullman, Alabama, within the legal hours of sale, to-wit: Eleven O'clock A.M. to Four O'clock PM, on the 5th day of May, 2017, the real estate mortgaged by the mortgage, being more particularly described as lying and being situated in the County of Cullman, State of Alabama, to-wit:

A parcel of land located in the NE 1/4 of the SE 1/4 of Section 28, Township 10 South, Range 4 West, more particularly described as follows: Commence at the SE corner of said Section 28; thence north along the section line a distance of 1951 feet to the true point of beginning; thence continue north a distance of 350 feet to a point in the center line of Old Birch Road (now known as County Road 818); thence 94 degrees 25 minutes left in a westerly direction along the center line of Old Birch Road (County Road 818) a distance of 350 feet to the northeast corner of a parcel previously conveyed as a parcel previously conveyed as described in instrument filed in Deed Book 343, Page 551 and corrected by instrument filed in Deed Book 398, Page 263 in the Probate Office of Cullman County, Alabama; thence in a southerly direction along the east line of the parcel previously conveyed a distance of 350 feet; thence in an easterly direction a distance of 350 feet, more or less, to the point of beginning. Less and except that portion of the subject property lying within County Road 818.

Together with all and singular the improvements thereon or appurtenances thereunto belonging, or in any wise appertaining.

This sale and conveyance will be made subject to any existing federal tax liens, if any, and/or special assessments, if any, which might adversely affect the title to subject property.

Said sale will be made subject to the right of redemption of the parties and for the purpose of foreclosing the mortgage, paying the costs thereof and a reasonable attorney's fee.
