Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Joshua S. Woodard, married man, and Nellie Woodard, his wife, originally in favor of Mortgage Electronic Registration Systems, Inc., as nominee for Consumer First Mortgage, Inc., on the 30th day of August, 2013, said mortgage recorded in the Office of the Judge of Probate of Cullman County, Alabama, in Mortgage Book 1717 Page 856; the undersigned PennyMac Loan Services, LLC , as Mortgagee/ Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the Courthouse at Cullman, Cullman County, Alabama, on July 28, 2017, during the legal hours of sale, all of its right, title, and interest in and to the following described real estate, situated in Cullman County, Alabama, to-wit:

A tract or parcel of land being a part of the Southwest Quarter of the Northwest Quarter of Section 4, Township 11 South, Range 2 West, Cullman County, Alabama and being more particularly described as follows:



Commence at the Southwest Corner of said Southwest Quarter of the Northwest Quarter of Section 4, and run North 00 degrees 00 minutes 00 seconds East and run along the West line, a distance of 630.00 feet; thence run North 90 degrees 00 minutes 00 seconds East, a distance of 420.00 feet to a found pipe marking the Point of Beginning; thence South 00 degrees 02 minutes 30 seconds West, a distance of 210.42 feet to a found pipe; thence South 89 degrees 44 minutes 59 seconds East, a distance of 368.89 feet to a found capped corner (21785); thence North 00 degrees 00 minutes 00 seconds East, a distance of 237.04 feet to a found capped corner (21785); thence North 90 degrees 00 minutes 00 seconds West, a distance of 368.72 feet to a found 1/2 inch rebar; thence South 00 degrees 02 minutes 30 seconds West, a distance of 25.00 feet to the Point of Beginning. Subject to any rights of way and/or easements of record. Description according to survey of Joseph E. Conn, III AL Reg No. 17831 dated October 3, 2011.



Also an easement for the purpose of ingress and egress being 50 feet in width and 25 feet evenly off the following described centerline. Commencing at the Southwest Corner of the Southwest Quarter of the Northwest Quarter of Section 4, thence North 00 degrees 00 minutes 00 seconds East along the West boundary of the Southwest Quarter of the Northwest Quarter for 630.00 feet to a nail; thence South 90 degrees 00 minutes 00 seconds East for 14.88 feet to the Easterly right of way margin of a paved county road, thence North 00 degrees 00 minutes 00 seconds East for 25.00 feet to the centerline of an ingress and egress easement being 50 feet in width, said point being the Point of Beginning; thence South 90 degrees 00 minutes 00 seconds East for 773.86 feet to the Point of Terminus. Said tract of land being subject to any existing easements and rights of way both recorded and unrecorded.

The successful bidder must tender a non-refundable deposit of Five Thousand Dollars ($5,000.00) in certified funds made payable to Sirote & Permutt, P.C. at the time and place of the sale. The balance of the purchase price must be paid in certified funds by noon the next business day at the Law Office of Sirote & Permutt, P.C. at the address indicated below. Sirote & Permutt, P.C. reserves the right to award the bid to the next highest bidder should the highest bidder fail to timely tender the total amount due.



The Mortgagee/Transferee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.
