Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Jacob Scott Fales, husband and wife Valerie K. Fales, originally in favor of Mortgage Electronic Registration Systems, Inc., as nominee for Cullman Savings Bank, on the 30th day of March, 2011, said mortgage recorded in the Office of the Judge of Probate of Cullman County, Alabama, in MTG Book 1648 Page 925; the undersigned Bank of America, N.A., as Mortgagee/Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the Courthouse at Cullman, Cullman County, Alabama, on October 27, 2017, during the legal hours of sale, all of its right, title, and interest in and to the following described real estate, situated in Cullman County, Alabama, to-wit:



Commence at the Southwest corner of the NW 1/4 of the NW 1/4 of Section 35, Township 8 South, Range 2 West; thence N 1 degree 10 minutes 00 seconds W 429.00 feet to a point; thence N 75 degrees 16 minutes 17 seconds E 101.23 feet to an iron pin found on the East margin of Fairview-Eva Road, said iron pin found being further described as being the true point of beginning for the property herein described; thence along said East margin of Fairview -Eva Road N 32 degrees 03 minutes 00 seconds W 202.00 feet to an iron pin set; thence S 77 degrees 17 minutes 01 seconds E 842.04 feet to an iron pin found; thence N 88 degrees 52 minutes 00 seconds W 715.00 feet to the true point of beginning. Said land lying and being in the NW 1/4 of the NW 1/4 of Section 35 and the NE 1/4 of the NE 1/4 of Section 34, Township 8 South, Range 2 West. Description according to survey of Robert L. Less and except: Commence at an iron pin located at the Northwest corner of the above described tract; thence S 77 degrees 17 minutes 01 seconds E along the north line of said tract a distance of 60 feet, more or less, to a point that is 5 feet East of the point of intersection of said North line with the East margin of a gravel drive; thence in a Southwesterly direction along a line 5 feet east of the east margin of a gravel drive to the East right of way of the Fairview-Eva Road; thence N 32 degrees 03 minutes 00 seconds W along the east right of way of Fairview-Eva Road a distance of 50 feet, more or less, to the point of beginning.



Also less and except: commence at the Southwest corner of the NW 1/4 of the NW 1/4 of Section 35, Township 8 South, Range 2 West; thence N 1 degree 10 minutes 00 seconds W 429.00 feet to a point; thence N 75 degrees 16 minutes 17 seconds E 101.23 feet to an iron pin found on the East margin of Fairview- Eva Road; thence S 88 degrees 52 minutes 00 seconds E 290 feet; more or less, to the West side of an existing building; thence N 88 degrees 52 minutes 00 seconds W 5 feet to the point of beginning; thence in a Northerly direction and parallel to said building a distance of 15 feet, more or less; thence in a Southeasterly direction parallel to the North side of an existing building a distance of 50 feet, more or less, to a point; thence in a Southeasterly direction and parallel to the East side of an existing building, a distance of 16 feet, more or less, to a point on the South line of the first tract herein described; thence N 88 degrees 52 minutes 00 seconds W a distance of 50 feet, more or less, to the point of beginning.

The balance of the purchase price must be paid in certified funds by noon the next business day at the Law Office of Sirote & Permutt, P.C. at the address indicated below. Sirote & Permutt, P.C. reserves the right to award the bid to the next highest bidder should the highest bidder fail to timely tender the total amount due.



The Mortgagee/Transferee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.
