FORECLOSURE SALE



Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Matthew F. Sawtelle and Mallory K. Sawtelle on August 10, 2011, originally in favor of Mortgage Electronic Registration Systems, Inc., as nominee for Consumer First Mortgage, Inc., which was recorded on August 12, 2011 in Mortgage Book 1656, Page 65 in the Office of the Judge of Probate of Cullman County, Alabama, and subsequently assigned and transferred to J.P. Morgan Mortgage Acquisition Corp., by an Assignment of Mortgage recorded on March 9, 2017 in Book 324, Page 162 in the Office of the Judge of Probate of Cullman County, Alabama.



Notice is hereby given that, under and by virtue of the power of sale and terms contained in said mortgage, Shelton, Harrison and Pinson, LLC, as counsel for Mortgagee/Transferee, will on June 14, 2017 sell at public outcry, for cash, to the highest bidder, in front of the Courthouse door of Cullman County, during the legal hours of sale, the following described real estate, situated in Cullman County, Alabama, to wit:



COMMENCING AT THE NORTHEAST CORNER OF THE NORTHEAST QUARTER OF THE NORTHWEST QUARTER, SECTION 24, TOWNSHIP 9 SOUTH, RANGE 5 WEST, THENCE SOUTH 88º30' WEST A DISTANCE OF 65 FEET TO A POINT; THENCE SOUTH 19º30' WEST A DISTANCE OF 642 FEET TO A POINT; THENCE SOUTH 49º30' WEST A DISTANCE OF 478 FEET TO A POINT; THENCE SOUTH 51º30' WEST A DISTANCE OF 210 FEET TO A POINT; THENCE NORTH 38º30' WEST A DISTANCE OF 18 FEET TO THE TRUE POINT OF BEGINNING; WHICH IS THE WEST RIGHT OF WAY OF COUNTY PAVED ROAD; THENCE ALONG THE SAME LINE A DISTANCE OF 210 FEET TO A POINT; THENCE NORTH 51º30' EAST A DISTANCE OF 210 FEET TO A POINT; THENCE SOUTH 38º30' EAST A DISTANCE OF 210 FEET TO A POINT ON THE WEST RIGHT OF WAY OF COUNTY PAVED ROAD, THENCE SOUTH 51º30' WEST ALONG SAID RIGHT OF WAY A DISTANCE OF 210 FEET TO THE POINT OF BEGINNING, BEING LOCATED IN CULLMAN COUNTY, ALABAMA.

This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expense of foreclosure. THE PROPERTY IS BEING SOLD "AS IS, WHERE IS". SAID PROPERTY IS SOLD WITHOUT WARRANT OR RECOURSE, EXPRESSED OR IMPLIED AS TO TITLE, USE, OR ENJOYMENT AND WILL BE SOLD SUBJECT TO THE RIGHT OF REDEMPTION OF ALL PARTIES ENTITLED THERETO. Neither the mortgagee, nor the officers, directors, attorneys, employees, agents or authorized representative of the mortgagee make any representation or warranty relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the property offered for sale.
