UNDER POWER



Default having been made in the payment of the indebtedness secured by that certain Real Estate Mortgage executed by Michelle Peak, an unmarried woman, to the United States of America, acting through the Rural Housing Service, or its successor agency, United States Department of Agriculture, dated June 27, 2005, recorded June 28, 2005, in the Office of the Judge of Probate of Cullman County, Alabama, in Mortgage Book 1432, Page(s) 973-979; and



The entire indebtedness secured by the said Real Estate Mortgage having been declared due and payable as therein provided, the undersigned, the United States of America, acting through its authorized representative, under and in compliance with the power of sale in said Real Estate Mortgage, will proceed to sell at public outcry, for cash, to the highest bidder in front of the courthouse of said County, during the legal hours of sale, on the 9th day of May, 2017, the following described property conveyed by said Real Estate Mortgage, to-wit:



A part of the NW1/4 of the SW1/4 and the NE1/4 of the SW1/4 of Section 18, Township 10 South, Range 5 West, more particularly described as follows: Commencing at a found 1/2 inch rebar iron marking the northwest corner of said Section 18; thence S 1°07'00" W a distance of 2670.59 feet to a found 1/2 inch iron capped 11845 marking the Southwest corner of the Southwest quarter of the Northwest quarter of said Section 18; thence S 88°46'44" E a distance of 1231.64 feet to a found 1 inch pipe capped 11845 (said corner shown on plat made by Baldy and Tucker Surveying as being N 89°49'36” W, 128.36 feet from the Southeast corner of Southwest Quarter of Northwest quarter of said Section 18); thence S 89°49' 36" E 19.36 feet to a set 5/8 inch rebar iron and the true point of beginning of the property herein described; thence run S 89°49'36" E 109.00 feet to a set 5/8 inch rebar iron marking the Southeast corner of the Southwest quarter of the Northwest quarter of Section 18, per Baldy and Tucker survey dated July 30th, 1997; thence S 89°49'36" E along the North line of the Northeast quarter of the Southwest quarter of said Section 18, per the above referenced survey, a distance of 188.12 feet to a set 5/8 inch rebar iron on the North right of way of Alabama Highway No. 278 West; thence S 61°28'06" W along said right of way a distance of 315.87 feet to a set 5/8 inch rebar iron at an agreed point; thence leaving said right of way run N 7°21'43" W along an agreed line a distance of 153.03 feet to a set 5/8 inch rebar iron and the true point of beginning.



Subject to all mineral rights, easements, covenants or other interest of record.



The proceeds of said sale will be applied to the payment of said indebtedness to the United States of America, other charges and the expenses of sale, as provided in said Real Estate Mortgage to the United States of America.
