FORECLOSURE SALE



Default having been made in the payment of the indebtedness secured by that certain mortgage executed by JEREMY D. DAHLKE and wife, MELISSA D. DAHLKE, in favor of Cullman Savings Bank, on the 12th day of April 2007, said mortgage recorded in the Office of the Judge of Probate of Cullman County, Alabama, in Mortgage Book 1516, Page 504; the undersigned Cullman Savings Bank as Mortgagee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the Courthouse at Cullman County, Alabama, on May 11, 2017, during the legal hours of sale, all of its right, title, and interest in and to the following described real estate, situated in Cullman County, Alabama, to-wit:



A parcel of land in the SE ¼ of the NE ¼ of Section 10, Township 11 South, Range 3 West, Cullman County, Alabama, being more particularly described as follows:

Commence at the NW corner of said forty; thence South 88 degrees 31 minutes 48 seconds East a distance of 275.78 feet to a point; thence South 01 degrees 00 minutes West a distance of 187.74 feet to the point of beginning; thence continue South 01 degrees 00 minutes West a distance of 308.12 feet to a point; thence South 88 degrees 27 minutes 30 seconds East a distance of 150.0 feet to a point; thence North 01 degrees 00 minutes East a distance of 308.31 feet to a point; thence North 88 degrees 31 minutes 48 seconds West a distance of 150.0 feet to the point of beginning.



ALSO a 20-foot wide egress-ingress easement being further described as follows: Begin at the SW corner of the above-described property; thence South 88 degrees 27 minutes 30 seconds East a distance of 1,010.4 feet to a point on the West margin of Golf Course Road; thence North 00 degrees 22 seconds East along said road a distance of 20.0 feet to a point; thence North 88 degrees 27 minutes 30 seconds West a distance of 1,010.4 feet to a point; thence South 01 degrees 00 minutes West a distance of 20.0 feet to the point of beginning.

This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the Office of the Judge of Probate of the County where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.



This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure. The purchase price must be paid in certified funds by close of business on the date of sale at the Law Office of Bland, Harris & McClellan, P.C. at the address indicated below. Bland, Harris & McClellan, P.C. reserves the right to award the bid to the next highest bidder should the highest bidder fail to timely tender the total amount due. The Mortgagee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.
