Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Kenneth T. Boyd and wife, Myra L. Boyd, originally in favor of Mortgage Electronic Registration Systems, Inc., as nominee for American Advisors Group, on the 26th day of December, 2011, said mortgage recorded in the Office of the Judge of Probate of Cullman County, Alabama, in Mtg Book 1667 Page 225; the undersigned Finance of America Reverse LLC, as Mortgagee/Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the Courthouse at Cullman, Cullman County, Alabama, on December 29, 2017, during the legal hours of sale, all of its right, title, and interest in and to the following described real estate, situated in Cullman County, Alabama, to-wit:



Beginning at a point on the West line of the Southwest Quarter of the Southwest Quarter of Section 11, Township 11, Range 2 West, where the Hanceville and Holly Pond Public Road intersects said forty line, thence in an Easterly direction along said public road a distance of 130 yards, thence due North 80 yards to the Cullman and Blountsville Public Road, thence in a Northwesterly direction along said road crosses the West line of said forty, thence South along the West line of said forty to the point of beginning, save and excepting, therefrom a parcel of land described as follows; beginning at the Southwest corner of said parcel of land, running East along the Hanceville and Holly Pond Public Road 130 yards, thence due North 72 yards, thence in a Westerly direction in a straight line to a point on the West line of said forty, which said point is 60 yards North of said road, thence South 60 yards to the public road, or point of beginning.



Less and except therefrom the following:



A tract of land in the Southeast corner of the following described property: beginning at a point on the West line of the Southwest Quarter of the Southwest Quarter of Section 11, Township 11, Range 2 West, where the Hanceville and Holly Pond Public Road intersects said forty line, thence in an Easterly direction along said public road.



A distance of 130 yards, thence due North 80 yards to the Cullman and Blountsville Public Road, thence in a Northwesterly direction along said road to where said road crosses the West line of said forty, thence South along the West line of said forty to the point of beginning, save and excepting therefrom a parcel of land described as follows: beginning at the Southwest corner of said parcel of land, running East along the Hanceville and Holly Pond Public Road 130 yards, thence due North 72 yards, thence in a Westerly direction in a straight line to a point on the West line of said forty, which said point is 60 yards North of said road, thence South 60 yards to the public road or point of beginning.



The property hereby conveyed is more particularly described as follows: commence where the South line of the above described property crosses the West line of the Southwest Quarter of Southwest Quarter of Section 11, Township 11 South, Range 2 West, thence in an Easterly direction along South line of said tract a distance of 130 yards, which is the point of beginning of the property here conveyed, thence North 8 yards to the Southwest right of way line of the Cullman and Blountsville Road, thence in a Northwesterly direction along the said road line a distance of 42 yards, thence West 70 yards, thence South to the South line of the tract of land herein above described, thence East along the South line of said tract of land to the point of beginning, containing 1 acres, more or less. Also, less and except the following: a part of the Southwest Quarter of the Southwest Quarter of Section 11, Township 11 South, Range 2 West, which is more particularly described as follows; begin at Northwest corner of said forty acre tract, thence South along West line of the forty a distance of 225 feet, thence 101.11 minutes left a distance of 126 feet to the center of Cullman and Blountsville Road, thence in a Northwest direction along center of said road to North line of the forty, thence West along North line of the forty 22 feet to the point of beginning. Containing 0.37 of an acre, more or less.

The successful bidder must tender a non-refundable deposit of Five Thousand Dollars ($5,000.00) in certified funds made payable to Sirote & Permutt, P.C. at the time and place of the sale. The balance of the purchase price must be paid in certified funds by noon the next business day at the Law Office of Sirote & Permutt, P.C. at the address indicated below. Sirote & Permutt, P.C. reserves the right to award the bid to the next highest bidder should the highest bidder fail to timely tender the total amount due.



The Mortgagee/Transferee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.
