Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Jonathan D. Banks, a married man, originally in favor of Mortgage Electronic Registration Systems, Inc., as nominee for Peoples Bank of Alabama, on the 1st day of June, 2015, said mortgage recorded in the Office of the Judge of Probate of Cullman County, Alabama, in MTG Book 1761, Page 877; the undersigned PennyMac Loan Services, as Mortgagee/Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the Courthouse at Cullman, Cullman County, Alabama, on July 28, 2017, during the legal hours of sale, all of its right, title, and interest in and to the following described real estate, situated in Cullman County, Alabama, to-wit:



A tract or parcel of land being a part of the NW 1/4 of the SE 1/4 of Section 36, Township 12 South, Range 5 West, Cullman County, Alabama, and being more particularly described as follows: Commence at a found capped rebar (Conn-17831) marking the northeast corner of said NW 1/4 of the SE 1/4 of said Section 36 and run South 00 degrees 10 minutes 17 seconds West and run along the east line, a distance of 356.89 feet to a found capped corner (Conn-17831); thence run South 75 degrees 49 minutes 09 seconds West a distance of 763.30 feet to a set rebar marking the point of beginning; thence South 73 degrees 38 minutes 43 seconds West a distance of 149.06 feet to a set rebar on the east line of that certain tract conveyed to Donald and Stacy Banks by deed recorded in Deed Book 482, Page 646; thence North 20 degrees 46 minutes 21 seconds West a distance of 147.67 feet to a found 5/8 inch rebar in the center of Cullman County Road No. 60 marking the northeast corner of said Banks’ tract; thence North 37 degrees 18 minutes 41 seconds East, and run along said centerline, a distance of 50.68 feet to a point; thence North 55 degrees 23 minutes 54 seconds East, continuing along said centerline, a distance of 83.46 feet to a set rebar; thence South 27 degrees 34 minutes 29 seconds East, departing said centerline, a distance of 207.35 feet to the point of beginning. Less and except all that part of the above described property that is within the right-of-way of Cullman County Road No. 60.

The successful bidder must tender a non-refundable deposit of Five Thousand Dollars ($5,000.00) in certified funds made payable to Sirote & Permutt, P.C. at the time and place of the sale. The balance of the purchase price must be paid in certified funds by noon the next business day at the Law Office of Sirote & Permutt, P.C. at the address indicated below. Sirote & Permutt, P.C. reserves the right to award the bid to the next highest bidder should the highest bidder fail to timely tender the total amount due.



The Mortgagee/Transferee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.
