NOTICE OF FORECLOSURE

Default having been made in the payment of the indebtedness secured by that certain mortgage dated October 18, 2024, executed by Zachary Tyler Thomas, A Single man, As Sole Ownership, to Mortgage Electronic Registration Systems, Inc., solely as nominee for United Wholesale Mortgage, LLC, which mortgage was recorded on October 21, 2024, in Book 2100, Page 372 Instrument Number 375574, of the mortgage records in the Office of the Judge of Probate of Cullman County, Alabama and which mortgage was duly transferred and assigned to United Wholesale Mortgage, LLC, notice is hereby given that pursuant to law and the power of sale contained in said mortgage, the undersigned will sell at public outcry, to the highest bidder for cash, at the backside of the Cullman County Courthouse at Cullman, Alabama during the legal hours of sale on September 24, 2026, the following described real estate, situated in Cullman County, Alabama, to-wit:

Tract 1: All that part of the Southwest Quarter of the Southwest Quarter of Section 3, Township l0 South. Range 3 West, more particularly described as beginning at an existing rebar iron marking the point of intersection of the South line of said forty and the East right of way of Second Avenue Northeast; thence N 48 degrees 44'09" W along said right of way a distance of 31.31 feet to a set 5/8 inch rebar iron: thence due East, crossing an existing iron at 60.98 feet, a distance of 140.98 feet to a set 5/8 inch rebar iron. Thence Due North a distance of 95.00 feet to a set 5/8 inch rebar iron: thence N 89 degrees 56'16" E a distance of 301.36 feet to an existing 1 1/2 inch pipe; thence S 1 degree 05'35" W a distance of 116.00 feet to a set 5/8 inch rebar iron, thence due West a distance of 416.59 feet to the true point of beginning and containing 0.86 acres. more or less.

Tract ll: All that part of the Southwest Quarter of the Southwest Quarter of Section 3, Township 10 South, Range 3 West, more particularly described as beginning at an existing rebar iron marking the point of intersection of the South line of said forty and the East right of Second Avenue Northeast; thence N 48 degrees 44' 09" W along said right of way a distance of 31.31 feet to a set 5/8 inch rebar iron; thence due East a distance of 60.98 feet to an existing iron and the one point of beginning of the property herein described; thence from said true point of beginning run due North a distance of 95.00 feet to a set 5/8 inch rebar iron: thence due East a distance of 80.00 feet to a set 5/8 inch rebar iron, thence due South a distance of 95.00 feet to a set 5/8 inch rebar iron; thence due West a distance of 80.00 feet to the true point of beginning and containing 0.17 acres more or less.

LESS AND EXCEPT: A tract or parcel of land being situated in the W 1/2 of the SW 1/4 of the SW 1/4 of Section 3, Township 10 South. Range 3 West, Cullman County, Alabama, and being more particularly described as follows: Commence at a found rock marking the southeast corner of said W 1/2 and run N 88deg. 55' 21" W and run along the south line a distance of 450.74 feet to a point marking the easterly right-of-way line of Second Avenue Northeast (based on 40' ROW); thence run N 41deg.22'08" W and run along said right-of-way line a distance of 29.27 feet; to a found rebar; thence run S 89deg.27' 08" E distance of 62.42 feet to a found rebar marking the point of beginning; thence continue S89deg. 27' 08" E a distance 29.3 feet to an old fence line; thence run N 00deg. 32' 52" along said old fence line a distance 95.00 feet: thence run N 89deg.27' 08" W distance 29.3 feet to a set rebar; thence run S 00deg. 32'52" W a distance of 95.00 feet to a rebar and marking the point of beginning.

Subject to utility easement to the City of Cullman as recorded in Fiche 1076, Frame G1 in the Office of the Judge of Probate of Cullman County, Alabama.

This sale is made for the purpose of paying the indebtedness secured by said mortgage as well as expenses of foreclosure. This property will be sold on an "as is, where is" basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the County where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to condition, title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
