Default having been made in the payment of the indebtedness secured by that certain mortgage given by Timothy Ace McCollins and Leah A. McCollins, husband and wife to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Freedom Mortgage Corporation, dated January 23, 2024, and recorded in Book 2073 at Page 364 on January 26, 2024, in the Office of the Judge of Probate of Cullman County, Alabama, as last transferred to Freedom Mortgage Corporation by assignment, recorded on May 19, 2025, in Book 2122, at Page 161 in the Office of the Judge of Probate of Cullman County, Alabama, conveying the after-described property to secure a Note in the original principal amount of Two Hundred Seven Thousand One Hundred Seventy-Eight and 0/100 dollars ($207,178.00), with interest thereon as set forth therein. Scott, PLLC, as counsel for Mortgagee or Transferee and under and by virtue of power of sale contained in the said mortgage will, on August 13, 2026, sell at public outcry to the highest bidder for cash at the main courthouse entrance of Cullman County, Alabama, within the legal hours of sale, the following described property:
Lot 17, Block 43, according to the Survey of Dean's Re-Subdivision of Lots 5, 6, 7, 8, 9, and 10 and parts of Lots 1, 2, 3, and 4 in Block 43 of Williams Addition to the Town of Hanceville as recorded in Map Book 2, Page 88 (A-105) in the Office of the Judge of Probate of Cullman County, Alabama.
Also: Lot 5, according to the Survey of Vansant's Addition to the Town of Hanceville as recorded in Map Book 3, Page 165 (A-180) in the Office of the Judge of Probate of Cullman County, Alabama.
Also: Lot No. 16 in Dean Resubdivision in the Town of Hanceville, Alabama, as recorded in the Office of the Judge of Probate of Cullman County, Alabama.
Also: Begin at the intersection of E. right of way of Hanceville- Center Hill road and SW right of way of Edmunson Road thence SW with Sd Road 140'S thence E 295'S to the South right of way of Edmunson Road, thence NW with right of way 200'S to the point of beginning.
The debt secured by said Mortgage has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Mortgage. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Mortgage and by law, including attorney's fees.
This property will be sold on an "as is, where is" basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the Office of the Judge of Probate of the County where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.

The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the mortgage and (3) any right of redemption or other lien not extinguished by foreclosure.
