POSTPONEMENT OF NOTICE OF FORECLOSURE SALE
Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Roger Brooks and Rebecca Diane Owens, Husband and Wife as Joint Tenants with Right of Survivorship, to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Southpoint Bank, its successors and assigns, on March 7, 2022, said mortgage being recorded in the Office of the Judge of Probate of Cullman County, Alabama, on March 8, 2022 at Book 2004, at Page 684, and said mortgage being re-recorded on March 16, 2022, at Book 2006, at Page 87. Freedom Mortgage Corporation, the current holder, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the Cullman County Courthouse, in Cullman, Alabama, on January 8, 2026, during the legal hours of sale, the following described real estate, situated in Cullman County, Alabama, to-wit:
Commence at a point where the North right of way line of County Road 715 intersects the West line of the East half of the Northeast Quarter of the Northeast Quarter of Section 31, T10S, R2W, as evidenced by a fence line and run S 42 degrees 00'00"E a distance of 516.58 feet to an existing 5/8 inch rebar iron and the true point of beginning of the property herein described; thence from said true point of beginning run N 34 degrees 27'01"E a distance of 101.14 feet to an existing rebar iron; thence S71 degrees 10'58"E a distance of 128.73 feet to an existing rebar iron; thence S 22 degrees 23'36"W a distance of 123.64 feet to an existing rebar iron on the North right of way line of County Road 715; thence N 64 degrees 55'22"W along said right of way a distance of 81.93 feet; thence continue along said right of way line, run N 56 degrees 51'24"W a distance of 68.98 feet to the true point of beginning. Said tract lying in and being a part of the Northeast Quarter of the Northeast Quarter of Section 31, T10S, R2W, Cullman County, Alabama, and containing 0.37 acres, more or less.

This Property will be sold on as "as is, where is" basis, without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
